Need some help with tenant rights in Arkansas…?
It’s a weird situation, so please only advise if you have good knowledge of the subject. I had a one-year lease, starting in March 2008, on a home. It was being managed by a real estate company on behalf of a man who has been deployed to Iraq. He had some curveballs financially, and ended up getting foreclosed on. The home is now owned by Fannie Mae. They called me and offered me a certain financial compensation for moving out within two weeks, something I haven’t been able to accomplish. However, we were still having phone conversations and, I believed, were negotiating in good faith. Then I received a summons for unlawful detainer a couple of days ago. It stated that I had been served a three-day quit notice by mail, which I never received. Can anyone tell me if I have any rights that protect me in this situation without having to go to the expense of hiring an attorney? Thank you.
The bank took back the house. They do not have to negotiate with you at all. They want you out.
They offered you money to move out and you failed to do so. Now they are forced to evict you.
As long as the bank can prove that the 3 day notice was mailed, the eviction will continue.
You can argue that you did not receive the notice in your answer to the summons and then argue your defense (no 3 day notice) in court. If the judge believes you, then the case will be dismissed and the bank would have to start over by serving you a new 3 day notice.
